Illinois Living Wills

Health Care Directives

Living Wills are sometimes called Health Care Directives or Medical Directives.  Under the federal Patient Self Determination Act (PSDA), you have the right to be informed about healthcare choices and make decisions on how you are to be treated including making these medical care decisions in advance.  You have a right to create a health care directive under the the Illinois Living Will Act 755 ILCS 35.  You can create a valid Living Will that meet these criteria using LegacyWriter's online questionnaire.

Illinois Requirements

The following requirements must be met to create an Illinois Living Will:

  • person must be an adult
  • person must have the capacity to make health care decisions
  • person is not being forced into writing a Living Will

Agent

In a Living Will you state what health care you want to receive at the end of life.  When using LegacyWriter to create your Illinois Living Will, you can also appoint someone to enforce your wishes.  This can be a Agent appointed in a separate Health Care Power of Attorney, or in some cases the Agent may be named in the Living Will; our questionnaire will walk you through the options available to you.  With an Agent you will have a person you trust to act on your behalf.
