Delaware Wills

Laws concerning Delaware Wills are found in Title 12 of the Delaware State Code.  You can use LegacyWriter's online questionnaire to create a legal and valid Will that meet these criteria.

Who Can Make a Will?

A Delaware Will can be created by an adult who is of sound mind at the time of creating the document.

Delaware Estate Taxes

Upon your death federal and Delaware taxes can be collected.  If your estate is large enough to meet the minimum filing standards ($1.5 million for deaths in 2005), the executor of your estate has 9 months to file United States Estate Tax Return (IRS Form 706) and pay any taxes that are due.

Probate: Delaware courts and your Last Will

Probate is a court-supervised process for gathering the deceased person's assets, paying taxes, claims and expenses and distributing assets to beneficiaries.  A person's assets that are processed in probate include both items described in a Delaware Will and even assets that may not be explicitly listed in the Will.
