Indiana Power of Attorney Form

Financial POA

The Indiana Financial Power of Attorney form is used to create a Financial Power of Attorney where you assign a person (the "Agent") to act upon your behalf.  When creating this Power of Attorney you can specify exactly which financial matters you want your Agent to be able to manage; for example, you may only want your agent to be able to make Real Estate transactions for you.  An Indiana Financial POA can go immediately into effect, or you can choose to have it go into effect when you become incapacitated and unable to communicate.  For estate planning purposes a person often chooses to create a Financial POA that will go into effect upon incapacity (this is often called a "springing" Power of Attorney).

Health Care POA

The Indiana Health Care Power of Attorney Form is used to create a Health Care POA (often referred to as a Medical POA).  You have the right to create a Health Care POA under Section 16-36-1-1, et seq., of the Indiana Code also known as the Health Care Consent Act.  With a Health Care POA you are appointing an "Agent" to make health care decisions on your behalf.  This Power of Attorney only goes into effect if you become incapacitated and are unable to communicate your own health care wishes.  If you have a Living Will, your Agent will have the ability to interpret and enforce your wishes in the Living Will.
